There is a widespread belief that as long as you’re in public, you can take pictures of anyone you like. While the Data Protection Act 2018 does allow journalists and artists significant exemptions from normal GDPR practice in the public interest, data protection covers the taking of images. Photography is plainly not forbidden, but especially if you’re capturing images for commercial or PR purposes, you need to think about what you’re doing like any other situation where you gather personal data.
The crucial issues here are the lawful basis for obtaining the images (which is likely to be legitimate interests), fairness and especially transparency. It’s not difficult to get this right, but it can be very embarrassing if you get it wrong. So watch my video and start snapping.
